I am traveling to India in november and need to get my H1b visa stamped. Somebody told me that as a part of requirement my passport should be valid for 6 months after the visa expiry date. Please advise if this is true.

I am new to IV. I am just wondering whether we have ever emphasized on bifurcation of Immigration Bill or call for a interim law to facilitate legal immigrant's issues ( mainly retro victims) -
Our problems are very basic and do not have sociopolitical or economical strings attached to it (Probably works better for economy as lot of us are holding on to buy houses and other big budget stuff).
The main issue I have is
- Unable to change jobs
I can wait for GC but not being able to change jobs is hurting me most.
Employers do not find projects and do not pay on bench. Once you find a project Employer wants a big cut. All in the name of policy ;) .
Please share your thoughts.
Your issue is same as everyone's here. SKIL bill does not have anything to do with illegals, but CIR does. This organization is keeping all options open and doing everything, but for some reason, there does not seem to be an easy rsolution to our issue. The group is working hard with support of members, other similar organizations, well wishers, members, some politicians, lobbyists, media etc..

My EB2- I140 (INDIA) approved on March 09, 2007. We also have received our EAD last year after filing I-485 in July 2007.
I was checking online status and for my I-140, last updated date shows January 06, 2008. (My EB2 PD is OCT 2006). Can any one explain why the I-140 showing update date of 01/06/2008. The online status says following text :
Application Type: I140, IMMIGRANT PETITION FOR ALIEN WORKER
Current Status: Case approved; approval notice e-mailed.
On March 9, 2007, this I140 IMMIGRANT PETITION FOR ALIEN WORKER was approved and we sent you an e-mail notice. Please follow any instructions on the notice. If you move before you receive the notice, call customer service.
I am little bit confuse.

Our checks were cashed today (both for me and my husband). Our application (I 140/I485 conc.) was July 2nd @NSC received by R Williams. They were cashed in Texas. We did not even get the receipt notices yet. Thus, the wait sounds longer for us.

One lawyer told me that according to new regulations only jobs on Job Zone Five can apply for EB2. If this is true only 15-1011.00 - Computer and Information Scientists, Research can apply for EB2 for ITJobs.
Anyone knows if this is true?
I am in Job Zone 4 as a Computer Software Engineer and want to apply under EB2. But if this new rule is true I do not want to apply under EB3 and prefer to go back to my country.

Hi. I am currently here in the US applying for AOS from a B2 to F1 visa. I sent my application on the 26th April with USPS Express mail request return reciept. My current 1 94 expired on April 28th. My return receipt from USPS says that my item was signed for on April 28th leaving me still in status but when I received my I 797 C it says that the receipt date is April 29th. I am very worried and I am wondering if this is something I should call their customer services department about. I do not want my application denied simply because I may seem not to be in status. Please help, I am very worried.
As long as you have a copy of the delivery receipt you are good and not out of status.

Google SEVIS I-20. The SEVIS system will tell USCIS and universities whether you are in status or not as per F-1 requirements. You will need to get a new I-20 and you are out-of-status until you have one.
2) Should i leave US and apply for a new visa and a new i 20 with that community college?
If yes, then what are my chances of getting a visa?
Don't do it. Your F-1 Visa will most probably be rejected due to this out-of-status issue. You might be able to get a new I-20 from outside the country but not a VISA.
3) What are my options??
Stick with Purdue and do as the International Advisor says (you don't have many options). Hopefully you will be reinstated (Purdue should have issued a new I-20 when they re-admitted you from community college. I am not sure why they overlooked)>

My friend is an F1 student (citizen of India) who has been in the US for 3 years as a grad student. She has paid US taxes on stipend/fellowship (1042S) received from US university while pursuing grad studies (filing taxes as a non resident in US, since the first 5 years on F1 are not counted towards substantial presence test).
Does she need to also pay taxes on this stipend in india, or report this income in india? AFAIK, no taxes need to be paid in India on this US stipend, but I couldnt find any authoritative reference online.
Am asking, since someone I know recently got a letter from IT dept in india saying that the US authorities reported $10K of income when that person was a student (this was a fellowship from the university on which US taxes have been paid) - and the letter goes on to ask the person to meet someone at the indian IT department. Anyone here experienced something similar before?

Can anybody please let me know what are the documents needed to file for 485. If I do not have any immunization record, how can I show that immunization record?
Somebody with experience please post. It has been answered earlier elsewhere, but I could not find it through search.

I was working with employer -A till 2006 and got I140 approved (Feb 2006) in EB3. In November 2006 I joined employer B as it is good for my carrier. I talk to employer A (body shopper) and he is ready to support for my green card as I worked for him for six long years and still he did not cancel my old H1B.
1. I have two options here my old employer (A) is body-shopper. So he will agree for both future or current employment. I have very good permanent job and bright future prospects with new employer (B). In this case what you guys advice me? Apply I485 as future employment or quit present job and join old employer (A) and apply I485 as current employment?
2. If I do not join old employer (with whom I have I140 approved) now, in this case what are my options for I485 applying? (Only future employment I485/ I can file current employment I485 and not drawing any salary from old employer )
3. Will I485 as future employment has any problems?
4. Can I use AC21 after 180 days on my I485 future employment application?
Appreciate your advice in this matter. Thanks in advance to all your replies and wish you best of luck.
